QashMarket Terms of Service

Effective Date: 3 November 2025

These Terms of Service ("Terms") govern your access to and use of the QashMarket web application ("Service"), which is operated by Fauziyah Md Aris (Qash Aris) ("we," "us," or "our"). QashMarket is a platform designed to connect micro‑entrepreneurs (sellers) with buyers, and is currently being developed as a personal product and part of a PhD research project.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part, do not use the Service.

1. Acceptance of Terms

By creating an account, accessing, or using the Service, you represent that you have read, understood, and agree to be bound by these Terms.

2. The QashMarket Service

• Our Role: We provide the platform and tools to enable sellers to list their products and buyers to discover and purchase them.
• Limitation of Liability for Transactions: We are not a party to any transaction between buyers and sellers. We do not guarantee the quality, safety, legality, or accuracy of listings, or the ability of buyers/sellers to complete transactions.

3. User Accounts and Registration

3.1. Account Creation

To use the Service, you must register for an account and provide accurate, current information.

3.2. Verification and Data Use

• We collect email, mobile phone number, and address for registration verification purposes only.
• By registering, you consent to the use of this data as outlined in our Privacy Policy (PDPA‑compliant).

3.3. User Roles

• Sellers are responsible for listings, legal compliance, and fulfilling orders.
• Buyers are responsible for reviewing listings and making payments.

4. Financial Terms and Payment Processing

4.1. QashMarket Subscription

• Access is subscription‑based. We process subscription payments via secure third‑party processors and do not store full card details.

4.2. Buyer‑Seller Transactions (Third‑Party Payment Gateway)

• All payments for goods/services between buyers and sellers are conducted directly between the buyer and seller using their respective Touch ’n Go e‑Wallets (or other agreed third‑party methods).
• QashMarket is not involved in processing, transferring, or storing funds for these transactions.
• Disputes about payments/refunds are to be resolved directly between buyer and seller.

5. User Obligations and Prohibited Conduct

Do not use the Service to violate Malaysian law (including the Consumer Protection Act 1999 and Electronic Commerce Act 2006), post unlawful content, infringe IP, or engage in fraud.

6. Intellectual Property

The Service and its original content are the property of Fauziyah Md Aris (Qash Aris) and licensors.

7. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.

8. Limitation of Liability

We shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data, or goodwill.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of Malaysia. You submit to the exclusive jurisdiction of the courts in Malaysia.

10. Changes to Terms

We may modify these Terms at any time with at least 30 days’ notice before new terms take effect. Continued use constitutes acceptance.
